Definitions
“User”, “you”, “your” means the User or Users of this Website, with any reference to the plural bearing the same meaning as reference to the singular and vice-versa, and where the Website is being used by an employee, representative, agent or officer of a legal entity, or someone acting on the legal entity’s behalf, also includes that legal entity;
“Malta Business School” or “MBS” means the Malta Business School;
“Terms of Use” or “Terms” means these terms of use as outlined below;
“Website” means the website of the Malta Business School, with URL www.mbs.edu.mt and extends to all parts of the website, all pages published on the Website (also referred to as “Web pages”), to any other MBS owned, operated, licensed or controlled sites (save where further terms of use are established to regulate such sites by MBS) as well as any content published thereon.
Acceptance
The services that Malta Business School (MBS) provides to you on the Website are subject to the following Terms of Use. By using this Website, you agree that this signifies your full agreement with these Terms of Use, Cookie Policy, Privacy Policy and agree to be legally bound by the same. MBS reserves the right to update the Terms at any time without notice to you. The most current version of the Terms can be reviewed by clicking on the “Terms of Use” hypertext link located at the bottom of our Web pages.
Description of Services
Through the Web pages, MBS provides you with access to a variety of resources, including download areas, communication forums and course content (collectively, the “Services”). The Services, including any updates, enhancements, new features, and/or the addition of any new Website properties, are subject to the Terms of Use.
Personal and Non-Commercial Use Limitation
Unless otherwise specified, the Services are for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, products or services obtained from the Services.
Documents Available on the Website
Permission to use Documents (such as press releases, datasheets and other materials) from the Services is granted, provided that (1) the copyright notice appears in all copies, (2) use of such Documents from the Services is for informational and non-commercial or personal use only and will not be copied or posted on any network computer or broadcast in any media or in any way whatsoever, and (3) no modifications of any Documents are made. Documents specified above do not include the design or layout of the Website or any other MBS owned, operated, licensed or controlled site.
Member Account, Password, and Security
If you are required to open an account, you must provide complete and accurate information as prompted by the registration form. You will also choose a password and a user name. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. You agree to keep MBS fully indemnified in the event that your account details, username or password are lost, stolen or misused in any way, including where this exposes your account to use by third parties. MBS will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge, including but not limited to with respect to third parties
However, MBS reserves the right to hold you liable liable for losses incurred by MBS or another party due to someone else using your account or password. You may not use anyone else’s account at any time, without the permission of the account holder.
Unlawful or Prohibited Use
As a condition of your use of the Services, you will not use the Services for any purpose that is unlawful or prohibited by these Terms. You may not attempt to gain unauthorized access to any Services, other accounts, computer systems or networks connected to any MBS server or to any of the Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services.
Indemnity
Through access and use of this Website, you agree to fully indemnify and hold harmless MBS, its partners, employees, directors, professionals, consultants, agents and affiliates from claims, liability, damages or costs of any and all kind. You also agree that in the event that you breach any of these Terms of Use, or in the occurrence of infringement of any rights including intellectual property rights related to content published on this Website, your breach of MBS’s policies and/or any other breach relating to the Website and its contents, without limitation, you shall also indemnify and hold MBS harmless to the same full extent. Such indemnification covers any and all claims arising from your use of this Website, or third-party claims brought in relation to this Website or use thereof. You are hereby assuming all risk for any consequence which may arise from use of this Website and waive any and all claims in respect thereof against MBS.

By using or accessing this Website or any page thereon, you accept, agree with and agree to be bound by the terms of our Privacy Policy.
Severability
The invalidity or unenforceability of any provision of these Terms of Use or of the Privacy Policy as determined by a court of competent jurisdiction or competent authority shal in no way affect the validity or enforceability of any other provisions of these Terms of Use.
Governing Law and Jurisdiction
Any dispute arising under these Terms of Use or related to the use of this Website shall be resolved according to Maltese Law which shall also be the governing law of any use of the Website and of the Services. Any such dispute shall fall within the exclusive jurisdiction of the Courts of Malta.
